I. BASIC PROVISIONS
- The controller of personal data pursuant to Article 4, point 7 of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter: “GDPR”) is outWork agency s.r.o., ID No.: 293 13 139, with registered office at Podpísečná 4017/8, Brno 615 00 (hereinafter: “Controller”).

- Personal data means any information you have provided in this form for the purpose of assessing your request for the relevant service. The legal basis for the processing of this data is the necessity to carry out pre-contractual measures based on the request of the person concerned. You are not obliged to provide personal data. However, if you do not provide it, you will not be able to receive the service.
- The controller has not appointed a data protection officer.
- There is no automatic individual decision-making on the part of the controller within the meaning of Article 22 GDPR.
II. REASON FOR PROCESSING PERSONAL DATA
- The lawful reason for processing personal data is your consent:
- To processing for the purpose of providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(a) GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on certain information society services, even if no order for goods or services has been placed. Our legitimate interest is to offer those interested in our services our other products and services. For this purpose, we may send you e-mail messages, letters, SMS, newsletters, as well as telephone you. In order to tailor an offer to you, we also process your creditworthiness data when creating an offer. As part of our marketing outreach, we conduct marketing research, client competitions, satisfaction surveys and similar activities that will reveal your opinion of our services. These activities are also authorised to be carried out in relation to you by entities that cooperate with us. If you do not wish to be contacted in any way, or if you are uncomfortable with a particular form of communication, please let us know and you will no longer receive offers.
- We will carry out the activities necessary to assess the suitability / feasibility / legality of the service you have requested (e.g. checking the service applicant against our internal records, publicly available information, databases and registers, information from registers …) as well as activities related to web and business analytics.
- You give your explicit consent to such processing by ticking the appropriate checkbox in the relevant form filled in remotely electronically.
III. PURPOSE OF PROCESSING, CATEGORIES, SOURCES AND RECIPIENTS OF PERSONAL DATA
- Personal data, which includes email address, name (or business name), telephone number and IP address, will be collected, stored and processed by the Controller for the following purposes:
- sending business and marketing offers and notifications from the Controller or third parties cooperating with the Controller,
- responding to enquiries,
- routine traffic analysis.
- Other personal data provided will be processed by the Controller only for the purposes of the service you have requested.
IV. DATA RETENTION PERIOD
- Unless otherwise specified in the preceding paragraphs, the Data Controller shall retain personal data
- referred to in Article III(1) for as long as the consent to the processing of personal data for marketing purposes is withdrawn, if the personal data are processed on the basis of consent.
- referred to in Article III(2) for the period necessary for the exercise of the rights and obligations arising from the negotiation, conclusion, performance and settlement of the contractual relationship between you and the Controller and the exercise of claims arising from such contractual relationship (for a period of 15 years from the termination of the contractual relationship).
- After the expiry of the retention period, the controller will delete the personal data.
V. YOUR RIGHTS
- Under the conditions set out in the GDPR, you have
- The right to access your personal data that we process about you in accordance with Article 15 of the GDPR,
- the right to rectification of inaccurate or incomplete personal data concerning you, pursuant to Article 16 of the GDPR,
- the right to restriction of processing pursuant to Article 18 GDPR,
- the right to erasure of personal data pursuant to Article 17 GDPR,
- the right to object to processing under Article 21 GDPR,
the right to data portability under Article 20 GDPR, i.e. you have the right to obtain the personal data concerning you that you have provided in a structured, commonly used and machine-readable format,
- the right to withdraw consent to processing in writing or electronically to the address or email of the controller set out in Article I of these terms and conditions.
- You also have the right to lodge a complaint with the Data Protection Authority if you believe that your right to data protection has been violated
VI. PERSONAL DATA SECURITY CONDITIONS
- The Controller declares that it has taken all appropriate technical and organisational measures to safeguard personal data.
- The controller has taken technical measures to secure data storage and storage of personal data in paper form.
VII. FINAL PROVISIONS
- By submitting an order from the online order form, you confirm that you are aware of the terms and conditions of data protection and that you accept them in their entirety.
- You agree to these terms and conditions by ticking the consent box via the online order form. By checking the consent box, you confirm that you are aware of the privacy policy and that you accept it in its entirety.
- The controller is entitled to change these terms and conditions. It will publish the new version of the Privacy Policy on its website and will also send you a new version of the Privacy Policy to the email address you have provided to the controller.
- These terms will take effect on 1 August 2023.
